Annual Leave Rules in China
Legal requirements in China for holidays and paid annual leave.
In China, most employees are entitled to paid annual leave, which is governed by the Labor Law of the People's Republic of China and the Regulations on Paid Annual Leave for Employees. According to Article 45 of the Labor Law, employees who have worked for one year or more are entitled to a minimum of five days of paid annual leave. This entitlement increases with the length of service: employees with 10 years of service are entitled to 10 days, and those with 20 years of service are entitled to 15 days. However, the actual number of leave days may vary based on company policies or collective agreements.
It is important to note that employees must take their annual leave within the year it is accrued, or they may lose their entitlement unless otherwise agreed upon with their employer. Employers are required to compensate employees for any unused leave if they are unable to take it due to work demands.
