We recognize that we have customers globally and that working weeks and hours are not the same. We will use commercially reasonable efforts to ensure that the website remains available at all times. We will apply industry-standard security measures to ensure the confidentiality, integrity, and availability of your data.
Your Commitments to Us
Where you are subscribed to Leavetrack, you will ensure that you keep a valid method of payment on account at all times.
You agree to keep confidential any passwords or other means of authenticating your account. Additionally, you agree not to misuse or abuse the Service, and any such misuse may result in termination of access.
Provision and Cancellation of Service
Leavetrack is provided on an "as-is" basis. In consideration of your ongoing subscription and payment, we promise that it will operate reasonably within the description set out on our website.
Subscriptions are payable monthly in advance. Cancellation will result in immediate and irretrievable deletion of your data as outlined in our Privacy Policy. You can export your account data from within Leavetrack. No refund will be given for any remaining term.
Where you have purchased a Lifetime Licence, you will have access to the Service for a minimum period of five years from the date of purchase. No further charges will be payable by you. We reserve the right to discontinue the Service at any time, in which case we will provide a pro-rata refund of any remaining term.
Disputes and Concerns
If there is a dispute that cannot be resolved amicably, we agree that the Courts of England & Wales will have jurisdiction, and the laws of England & Wales shall apply.

Intellectual Property
All intellectual property rights in the Service, including the software and content made available by us, are owned by Captured Sparks Limited or licensed to us. You may not copy, distribute, or exploit any part of the Service without our written consent.
You retain all rights to the content you submit to the Service, including employee data and leave records. By submitting content, you grant us a worldwide, royalty-free license to use, store, and process the content solely for the purpose of providing the Service.
Limitation of Liability
To the fullest extent permitted by law, Captured Sparks Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service. Our total liability shall not exceed the amount you have paid us in the last 12 months.
Force Majeure
We will not be liable for any delay or failure to perform our obligations if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, epidemics, or interruptions to internet service.
Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of England & Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Courts of England & Wales.
Amendments
We reserve the right to modify these terms at any time. Changes will be communicated to you through the Service or by email. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
